Please read these Terms & Conditions carefully before using Nemax AI. They govern your access to and use of our platform, services, and website.
1. Acceptance of Terms
By accessing or using Nemax AI's platform, services, or website (nemaxai.com), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.
2. Description of Service
Nemax AI provides AI-powered communication agents ("Arya") that automate inbound interactions across voice calls, WhatsApp, Instagram DMs, SMS, email, and other channels. The service is configured based on information and rules provided by the client.
3. Client Responsibilities
You are responsible for:
- Providing accurate business information used to train Arya.
- Ensuring all data shared with Nemax AI complies with applicable privacy laws.
- Reviewing and monitoring Arya's interactions on a regular basis.
- Updating your knowledge base as your business rules change.
4. No Contract Lock-In
Nemax AI operates on a zero contract lock-in basis. You may discontinue the service after your current billing period without penalty unless otherwise agreed in writing for Enterprise plans.
5. Deployment & Uptime
Nemax AI targets sub-1 second response latency across all channels. While we strive for maximum uptime, we do not guarantee uninterrupted service. Enterprise clients receive SLA-backed uptime commitments outlined in their individual agreements.
6. AI Limitations
Arya is an AI system trained on your provided data. Its accuracy depends on the quality and completeness of information you supply. Nemax AI is not liable for errors, missed escalations, or miscommunications resulting from incomplete or inaccurate client-provided data.
7. Human Handoff
Where escalation is triggered, Arya will provide your team with a full briefing including caller identity, sentiment, and context. Your team is responsible for all decisions made during and after handoff.
8. Data & Privacy
All client data is handled in accordance with our Privacy Policy. Nemax AI is GDPR compliant. We do not sell or share your business or customer data with third parties without explicit consent.
9. Intellectual Property
All technology, software, models, and systems underlying Arya remain the sole intellectual property of Nemax AI. Clients receive a limited, non-transferable license to use the service during their subscription period.
10. Payment & Billing
All plans are custom-priced and agreed upon before deployment. Invoices are issued monthly or annually depending on your plan. Late payments may result in service suspension.
11. Termination
Nemax AI reserves the right to suspend or terminate service if a client violates these Terms, engages in unlawful use of the platform, or fails to make payment after reasonable notice.
12. Limitation of Liability
Nemax AI's total liability to any client shall not exceed the total fees paid in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages of any kind.
13. Changes to Terms
We may update these Terms at any time. Continued use of the service after changes are posted constitutes acceptance of the updated Terms.
